  1. Preamble

We, the United National Congress Party (UNC), founded upon the principles of inclusivity unity, integrity, and service to the Nation, welcome you to our digital platforms.

By accessing, using, or registering through our website, mobile application, or any associated service, you affirm your agreement to these Terms and Conditions, made under in accordance with the Constitution of Kenya (2010), the Political Parties Act (2011), and the Data Protection Act (2019).

This document is both a legal contract and a moral covenant — between the Party and each member — based upon good faith, lawful conduct, and respect for privacy and human dignity.

  1. Acceptance of Terms

By using UNC’s digital platforms, you;

  1. Confirm that you are at least 18 years of age and a citizen of Kenya;
  2. Agree to abide by these Terms, our Privacy Policy, and all applicable laws;
  3. Acknowledge that your continued use of our services constitutes ongoing consent;
  4. Commit to truthfulness in all data provided, for deception is contrary to both the law and the divine order of truth.

IF YOU DISAGREE WITH ANY PART OF THESE TERMS, YOU ARE ADVISED TO REFRAIN FROM USING THE PLATFORM.

  1. Purpose of the Platform

The UNC digital platform is created to:

  1. Facilitate lawful party membership registration and verification;
  2. Support communication, education, and mobilization of members;
  3. Provide access to party updates, policies, and activities;
  4. Strengthen democratic participation through digital inclusivity.

NO PART OF THIS PLATFORM SHALL BE USED FOR UNLAWFUL, DEFAMATORY, OR DIVISIVE PURPOSES.

ALL ACTIVITIES MUST HONOR THE PRINCIPLES OF NATIONAL UNITY, PEACE, AND RESPECT FOR GOD AND MAN.

  1. Account Creation and Member Obligations

When you register on our platform, you undertake to:

  1. Provide accurate, current, and verifiable information (Name, ID, Age, Gender, Email, and phone contact).
  2. Keep your login credentials secure and confidential.
  3. Promptly update any changes to your personal data.
  4. Use the platform only for lawful, peaceful, and party-related purposes.

YOU ARE PERSONALLY RESPONSIBLE FOR ANY ACTIVITY UNDER YOUR ACCOUNT. MISUSE OF YOUR ACCOUNT FOR FRAUD, HATE SPEECH, OR MISINFORMATION SHALL LEAD TO SUSPENSION OR EXPULSION FROM THE PLATFORM AND, WHERE NECESSARY, PROSECUTION UNDER KENYAN LAW.

  1. Data and Privacy Commitment

Your data is important.

  1. UNC shall process your personal information in strict accordance with its Privacy Policy and the Data Protection Act, 2019, ensuring confidentiality, integrity, and fairness.
  2. Your information shall only be used for legitimate party functions and shall never be sold or disclosed for profit.
  1. Conduct and Ethical Use

Every member is bound by moral and ethical duty to;

  1. Uphold decency, honesty, and respect in all interactions;
  2. Refrain from using the platform for slander, tribalism, hate speech, or immorality;
  3. Avoid impersonation or submission of false information;
  4. Respect intellectual property, confidentiality, and dignity of others.

UNC RESERVES THE RIGHT AND AUTHORITY TO RESTRICT OR REMOVE ANY CONTENT THAT VIOLATES MORALITY, LAW, OR PUBLIC ORDER.

  1. Intellectual Property
  1. All materials, including the Party’s name, slogan, logo, colors, publications, and digital content, are the exclusive property of the United National Congress Party.
  1. You may view, download, or share content solely for personal and lawful use related to the Party’s objectives.
  1. Unauthorized reproduction, modification, or misuse is strictly prohibited and may attract civil or criminal action.
  1. Limitation of Liability

The UNC platform is provided “as is,” in good faith and with due diligence.

However, UNC does not guarantee uninterrupted or error-free operation and shall not be held liable for:

  1. Technical failures or delays beyond its control;
  2. Unauthorized use of your credentials;
  3. Losses or damages resulting from unlawful user actions.

Nevertheless, UNC commits to act with compassion, fairness, and responsibility in addressing any grievance that arises.

  1. Termination and Suspension

UNC reserves the right to suspend or terminate user access where:

  1. False or fraudulent information is provided;
  1. There is a breach of these Terms or applicable laws;
  1. The platform is used to propagate hate, malice, or disorder.

TERMINATION MAY OCCUR WITH OR WITHOUT PRIOR NOTICE, DEPENDING ON THE SEVERITY OF THE VIOLATION.

USERS MAY ALSO VOLUNTARILY DEACTIVATE THEIR ACCOUNTS AT ANY TIME THROUGH THE PARTY SECRETARIAT.

  1. Communication and Consent
  1. By registering with UNC, you consent to receive communications through email, SMS, or notifications regarding Party updates, events, and public interest matters.
  1. You may opt out of non-essential communications at any time by written notice to: privacy@unc.co.ke
  1. Divine and Legal Integrity Clause
  1. All actions within this platform must honor all guiding law and Kenya’s Constitution.
  1. The UNC upholds spiritual integrity, recognizing that leadership and service are sacred trusts.
  1. Any form of deceit, corruption, or injustice is a violation not only of law but of divine order.
  1. Jurisdiction and Governing Law
  1. These Terms shall be governed by and construed in accordance with the Laws of Kenya, under the jurisdiction of Kenyan courts.
  1. Where applicable, spiritual and moral reconciliation shall be encouraged before legal recourse is pursued.
  1. Amendments
  1. UNC reserves the right to amend these Terms from time to time to align with evolving laws, technologies, or moral considerations.
  1. Members shall be notified through the website, email, or other official communication channels.

CONTINUED USE OF THE PLATFORM CONSTITUTES ACCEPTANCE OF THE UPDATED TERMS.

  1. In the spirit of unity and divine service, the United National Congress Party declares that all digital and human engagements shall be governed by truth, transparency, and justice.
  1. We vow to respect the privacy and dignity of every citizen, to lead with integrity, and to honor God in all our dealings.

LET THESE TERMS STAND AS BOTH A LEGAL AGREEMENT AND A MORAL COVENANT, BETWEEN THE PARTY, ITS MEMBERS, AND THE ALMIGHTY GOD FOR THE GLORY OF KENYA AND THE PEACE OF HER PEOPLE.
